TERMS

Draft. A lawyer has to review this before Outbid Tube takes real money, and every [BRACKETED] item below has to be filled in — they are facts about the operator that cannot be guessed.

These Terms govern use of Outbid Tube: the public leaderboard, the video pages, checkout, and everything around them. Using the site or paying for a rank means you accept these Terms and the Privacy Policy. If you do not accept them, do not pay.

Who operates this

Outbid Tube is operated by [LEGAL NAME OR ENTITY], based in [COUNTRY / STATE]. Notices, including takedown and rights complaints, go to [LEGAL CONTACT EMAIL].

These Terms sit alongside the public Rules. Where the two conflict, these Terms win.

What you are buying

A position on a public leaderboard for a YouTube video you submit, held for exactly as long as nobody pays more. Listings are paid placements. They are not reviews, endorsements, awards, certifications, or any editorial judgment about the video.

A payment buys the rank that the amount supports at the moment it settles, and the crowner credit shown on that row. It does not buy views, clicks, subscribers, traffic, revenue, a guaranteed duration at any rank, exclusivity, search ranking, or any outcome at all. Anybody can pay more and pass you. That is the product working as described.

You are not buying the video, any rights in it, or any relationship with its creator, with YouTube, or with Google.

Who can use it

  • You have to be 18 or older and able to enter a binding contract.
  • Paying on behalf of a company means you have authority to bind it, and “you” includes that company.
  • You may not use the service if sanctions or the law of [COUNTRY] or another applicable jurisdiction prohibit it.

Payment

Checkout runs on Stripe. Card details go to Stripe, never to us — we never see or store a card number. Stripe’s own terms apply to the payment itself. Amounts are in US dollars.

You are charged exactly the amount you name. There is no processing fee added at checkout; card costs come out of what you pay us. Any tax that applies may be added at checkout.

Completing checkout is an offer to buy placement on the terms shown. The rank is assigned when Stripe confirms the payment and the entry is written to the board — not when the payment page closes. Some payment methods settle hours or days later, and the rank waits for the money.

No refunds

Every payment is final. Placement is a digital service that begins the moment payment confirms: the entry appears, the amount is public, and the crowner credit goes live. Being outbid, getting fewer views than you hoped, disliking the board, downtime, or a later removal for breaking these Terms does not create a refund.

By paying you ask us to start that service immediately and accept that you give up any statutory cooling-off or withdrawal right to the extent the law allows the waiver. Where a consumer right cannot be waived, we honor it. Raising a chargeback without a legal basis is a breach of these Terms, and we may remove the entry and refuse you future use.

What you promise about your video

By submitting a video and paying, you represent that:

  • You own that video or are authorized to promote it, and you are not claiming a rank for somebody else’s video without their permission.
  • The video and any site you link from your crowner credit comply with applicable law, including advertising, consumer, privacy, and intellectual-property rules.
  • You are not impersonating another person, channel, brand, or company.
  • Nothing you submit is malware, phishing, a scam, or designed to deceive visitors, and the details you give us are accurate.

What we will not list

Beyond the Rules: no sexual or adult content; nothing illegal, fraudulent, defamatory, harassing, hateful, or violent; nothing that exploits children; no infringement of copyright, trademark, or other rights; and no offers that need licenses you do not hold. Do not interfere with the service — no scraping beyond ordinary browsing, no inflating view counts, no bypassing rate limits, no automated rank claims without our written permission.

We can remove listings

We may refuse, delay, hide, or permanently remove any entry, rank, or page, with or without notice: where we think these Terms, the Rules, or the law have been broken; where a rights holder, a creator, or a platform complains; or where an entry creates legal, security, or reputational risk. Removal does not entitle you to a refund.

YouTube content on the board

To run the board we display publicly available information about submitted videos: titles, channel names, thumbnails, subscriber counts, and the official YouTube embed. We use it only to identify which video a paid rank points at. Videos play through YouTube’s own player and YouTube’s terms apply to that playback.

A rank does not imply that the video’s creator or channel endorses Outbid Tube, or that they were involved at all, unless the payer is that creator. If you are a creator and you do not want your video on the board, email [LEGAL CONTACT EMAIL] and we will remove it.

Outbid Tube, its wordmark, and the look of the site are ours. Do not copy the service or scrape the board for a competing product. YouTube, Stripe, and other third-party names belong to their owners.

Licence you give us

You grant us a worldwide, non-exclusive, royalty-free licence to host, cache, resize, and publicly display your entry and the crowner credit you supply — logo, handle, links — for as long as needed to run the board and keep its history. Asking for a takedown does not undo a completed payment.

Rights complaints

If you believe an entry infringes your rights or that a listed video is unlawful, email [LEGAL CONTACT EMAIL] with your contact details, the Outbid Tube page, the video, what the problem is, and a statement that your notice is accurate and you are entitled to make it. We may remove or restrict the entry while we review, and we may pass the notice to the payer. Repeat or abusive notices may be ignored.

No endorsement, no promises

A high rank means somebody paid. It is not our opinion of the video and we do not check any claim made in one. View counts and rank history describe what our systems recorded; they are not a prediction of what you will get.

Availability

The service is provided as-is. It may be slow, unavailable, or wrong. We may change ranking rules, minimums, or these Terms. Material changes update the date on this page, and continuing to use the site means you accept them. A payment already completed keeps the Terms in force at the time of that payment, unless the law or a security risk requires otherwise.

Disclaimers and liability

To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that ranks, names, images, or view counts are accurate.

We do not limit liability the law says we cannot limit. Subject to that: we are not liable for lost profits, lost data, lost goodwill, or indirect, incidental, special, or consequential damages; and our total liability for any claim about a payment is limited to the amount you paid us for the entry the claim concerns.

Indemnity

You will indemnify [LEGAL NAME OR ENTITY] and anyone working on the service against claims, damages, losses, and reasonable legal fees arising from your entry, the video you submitted, the links in your crowner credit, your payment or chargeback, your breach of these Terms, or your infringement of anyone’s rights.

Governing law

These Terms are governed by the laws of [JURISDICTION], excluding conflict-of-law rules. Courts in [VENUE] have exclusive jurisdiction to the extent permitted. A consumer protected by mandatory local law keeps that protection.

General

If part of these Terms is unenforceable, the rest stands. Not enforcing a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them with a transfer of the service. These Terms, the Rules, the Privacy Policy, and what you confirm at checkout are the whole agreement. Payment, hosting, and video metadata involve third parties, and their outages are outside our control.
